Participant Agreement
In consideration for the opportunity to participate in, as a consignor or volunteer, with the Simply Consignment Sale, the undersigned Participant agrees to the following:
- Consignor agrees to hold harmless and make no claim against Simply Consignment, LLC and its officers, the leasers or owners of the space where the sale is held, any volunteer or paid participants in the Simply Consignment Sale, or the insurer of Simply Consignment, LLC for the damage, theft, or loss of any items consigned to Simply Consignment, LLC. Simply Consignment, LLC does not anticipate any thefts, damage, or loss and takes every precaution to prevent them, but occasionally these events may occur.
- Consignor and/or Volunteer agrees to waive any and all claims for personal injury resulting from participation in the Simply Consignment Sale from whatever cause either foreseen or unforeseen against Simply Consignment, LLC and its officers, the leasers or owner of the space where the sale is held, any volunteer or paid participants in the Simply Consignment Sale, or the insurer of Simply Consignment, LLC.
- Consignors will receive 70% of the selling price on items that sell.
- Consignor that arranges pickup of items through Simply Consignment will ONLY receive 50% of the sale price of items that were picked up and sell. If the item does not sell, Simply Consignment will not be responsible for delivering the item back to the consignor. Consignors understand that the pickup company is separate and not related to Simply Consignment LLC and will not hold Simply Consignment LLC, it's owners or representatives responsible for any loss, damage or anything else that happens to any item that is left in the care of this pickup/delivery service. Consignor also realizes that anywhere else mentioned in this agreement or any other written or spoken words, if consignor split is referred to as 70% that the split will always be 50% of sale price, on any item that was arranged for pick up by Simply Consignment.
- Consignor agrees that on Sunday, October 14, 2007 or after, if the Consignor has marked the tag as a discounted item, it will then be sold for half of the original price. The consignor will receive 70% of the final selling price.
- All goods left in the possession of Simply Consignment, LLC are left at the sole risk of the Consignor. Consignor agrees that it shall assume and bear all risks regarding consigned goods, and will hold Simply Consignment, LLC exempt from any and all liability. Should items be lost, stolen or damaged, Simply Consignment, LLC is not responsible for compensating the Consignor for the items.
- Simply Consignment, LLC reserves the right to remove any items from the sale due to wear, poor condition, damage or stains.
- Consignor acknowledges that it is the consignor's responsibility to make sure that every item they bring is tagged using the tagging program offered on the Simply Consignment website. Any item that does not have a tag, due to any reason, will be sold at fair market value as determined by a representative of Simply Consignment, LLC. Consignor agrees to accept this as the final price for the item. If a price cannot be reasonably determined, then the item will not be sold.
- Items remaining after October 17th at 8pm will become property of Simply Consignment, LLC and may be donated.
- Consignor agrees that no claims will be made against Simply Consignment, LLC for any discrepancies involving items placed in the sale.
- Consignor agrees that unsold items marked with Donate on the tag will be donated at the end of the sale to the charity of choice of Simply Consignment LLC.
- All merchandise without tags that does not get claimed will become the property of Simply Consignment, LLC and may be donated.
- Consignor agrees to cash the proceed check(s) within 90 days of the date on the check.
- Simply Consignment has the right to refuse any consignor and/or volunteer from participating in our sale.
